Warranty on SJC Hutchinson (Engineering) Ltd. Manufactured Products

SJC Hutchinson (Engineering) Limited warrants that those Product(s) supplied against the Customer’s design and subsequent purchase order, and manufactured by Hutchinson (Engineering) Ltd, shall be free from manufacturing defects for a period of one (1) year from date of sale to the Customer, ie. date of delivery.

While any recommendation from SJC Hutchinson (Engineering) Ltd relating to the use of the Product(s) supplied against Customer/End User’s design and purchase order, or in response to a specific enquiry or otherwise given in good faith, it is for the Customer to satisfy themselves that such Product(s) are suitable for the purpose for which it or the End User intends to use them.

SJC Hutchinson (Engineering) shall have no obligation under this warranty if Customer subjects the Product to improper use and does not follow the Operating Instructions supplied with the Product(s).

It is a condition of this warranty that all required maintenance is carried out, and documented, in accordance with the Operating Instructions.

In no event shall SJC Hutchinson (Engineering) Ltd be liable for any indirect, consequential or punitive damages or other damages of any kind, however caused, with respect to the use of the product(s), regardless of the form of action (be it for breach of contract, warranty, negligence, tort or otherwise), including, but not limited to loss of profits or loss of use.

SJC Hutchinson (Engineering) Ltd’s sole and exclusive remedy under this warranty shall be replacement of the defective part(s) or Product(s), at SJC Hutchinson (Engineering) Ltd’s discretion and at no charge to the Customer, provided the defect(s) are shown to be as a direct result of faulty manufacture by SJC Hutchinson (Engineering) Ltd. Any Claims under this warranty shall be made in writing addressed to the seller and SJC Hutchinson (Engineering) Ltd within thirty (30) days from date of the alleged failure, including information as to the specific nature of the claimed failure. A representative of SJC Hutchinson (Engineering) Ltd and the seller shall be given reasonable opportunity to inspect the alleged failure.
